DUCT LAW

What does the Duct Law involve?
Law No. 20,808, Decree No. 167 and Technical Standard No. 766 form a technical framework jointly established by MINVU and Subtel, in effect since September 3, 2018, aimed at putting an end to any restriction on or exclusivity for telecommunications service providers (telephony, internet, satellite and digital cable TV) in high-rise and low-rise buildings, both new and existing. The law addresses the physical infrastructure and internal telecommunications network needed to enable access for multiple service operators, thereby allowing consumers free choice of provider.
Key considerations for compliance with the Law:

  1. Registration of the real estate project on the SUBTEL portal.
  2. Incorporating the Telecommunications Project into the set of specialty designs for a real estate project. (Required for obtaining the building permit).
  3. Holding the Registration Certificate on the Subtel portal in order to obtain final acceptance of the works. (Required document for obtaining the building permit and Final Acceptance).
  4. If the project is modified, the modification must also be reflected in the SUBTEL real estate project registry.
  5. Final acceptance of the works requires a favorable report confirming that the telecommunications network was built as a faithful reflection of the approved telecommunications project and in compliance with legal requirements.
